General

1. These Terms and Conditions apply to use of the Stockland Gift Card (Gift Card) which has been issued by Stockland Development Pty Limited ABN 71 000 064 835 of Level 25, 133 Castlereagh Street, Sydney NSW 2000 (Stockland) to you (the Participant) (“Stockland”)

2. Purchase or use of this Gift Card constitutes your acceptance of these Terms and Conditions.  A Gift Card can be purchased online via the Stockland website https://www.stockland.com.au/shopping-centres/gift-cards or in shopping centres at Customer Care desks where present, or Centre Management.  Where purchased online, the Physical cards will be delivered to your nominated address. A digital card will be delivered via email and SMS. Any card purchased online will be activated following security confirmation.

3. Participants should treat this Gift Card like cash. Defaced, mutilated, altered, lost or stolen Gift Cards will not be replaced, refunded, redeemed or returned.

4. A Gift Card is redeemable for merchandise or services at participating retailers at Stockland Shopping Centres and retailers who elect to accept the card and have the terminal facility across Australia that accepts Apple Pay and Google Pay (digital card) and Visa (physical card). Some retailers may choose not to accept the Gift Card.

5. A Gift Card can be redeemed at participating retailers with Apple Pay and Google Pay (digital card) facilities or who accept Visa (physical cards). Retailers without card terminals are unable to accept this Gift Card.

6. Retail stores may elect not to accept a Gift Card at their discretion. A customer should confirm acceptance of the use of a Gift Card with the retailer before a transaction is processed.

7. A Gift Card is non-refundable and cannot be redeemed for cash or used for the payment of credit or retailer accounts.

8. A Gift Card is partially redeemable. It is the responsibility of the customer to use the full value before the expiry date. Any unused balance on the Gift card will not be refunded. A Gift card cannot be reloaded. No further value may be added to it.

9. A purchased Gift Card is valid for thirty-six (36) months from the date of issue. Stockland may in its sole discretion elect to cancel a Gift Card before the expiry date or block a transaction with or without prior written notice to you.

10. A Gift Card cannot be reloaded. No further value may be added to it.

11. A Stockland Shopping Centre Gift Card cannot be redeemed at any time when participating retailer’s card terminal system is offline for any reason.

12. Any unused balance at expiry of the Gift Card will not be refunded or credited. It is up to the cardholder to use the full value within the validity period.

13. Purchases exceeding the Gift Card’s available balance requires the difference to be paid by the customer through other method/s such as cash, credit card or any other preferred payment methods.

14. A Gift Card can be credited with any amount between $10.00 and $500.00

15. Each of the participating retailer’s return policy applies when returning goods purchased with a Gift Card.

16. A customer can check their balance by logging on to the Centre’s website and clicking on the Gift Card link or by phoning the Gift Card Help Desk phone number available at https://www.stockland.com.au/shopping-centres/gift-cards.

Exceptions 

In accordance with the Australian Consumer Law, there are exceptions to expiry dates of a Gift Card, and these exceptions may include (but are not limited to) the following examples:
• Gift Cards donated for promotional purposes. 
• Available only for a specified period. 
• Supplied at a genuine discount. 
• Part of an employee reward scheme
• Part of a customer loyalty program
• Part of a temporary marketing promotion.

Privacy

2. Stockland will collect and use each participant’s personal information for the purposes of: 
(a) Providing the Gift Card (which may include disclosure to third parties for the purpose of processing the Gift Card) 
(b) providing information about the products and services offered by Stockland and its related companies; and 
(c) research to improve its products and services. 

3. By participating in the Promotion, participants consent to the use of their personal information as described in clause 5. 

4. Participants may access, change and/or update their personal information in accordance with the Promoter’s privacy policy https://www.stockland.com.au/privacy-policy.

Liability

1. You are responsible for use and safety of the Gift Card, and are liable for all transactions made using the Gift Card, except to the extent to which there has been fraud or negligence by Stockland or any of its employees or any of Stockland’s related companies.

2. Stockland and its related companies will not be liable for any damages, liabilities, expenses, fines or costs, nor be in breach of these Gift Card Terms and Conditions of Use, for any failure to perform any term of these Gift Card Terms and Conditions of Use for 
A) If  performance is delayed, prevented, restricted or interfered with for any reason outside Stockland Shopping Centres control, including but not limited to fire, flood, storm, earthquake, accident, war, acts of sabotage, labour dispute, materials or labour shortage (other than shortages of its own staff or staff under its control), system failure, power failure or shortage, law, regulation or act or omission of third persons, and;. 
B) any loss or corruption of data, interference with or damaged to your computer or any interruption, delay or failure of the Website.

3. The exclusion of Stockland liability and indemnity at clause 2 only applies to the extent permitted by law. Where consumer protection legislation implies any condition or warranty that cannot be excluded in these terms and conditions, Stockland limit our liability for breach of any such implied conditions or warranties to re-supply of the services (or cost thereof). Any liability Stockland have to you will be reduced by the extent (if any) to which you caused or contributed to the loss or damage.

Variation 

1. No variations of these Terms and Conditions of Use bind us unless they have been approved and signed by Stockland. Changes to the Terms and Conditions of Use will be available at Centre Management.

2. Visit Centre Management if you have any reason to believe that an error has occurred in relation to your Gift Card.

3. Stockland Shopping Centre reserves the right to change any term contained in these Gift Card Terms and Conditions of Use where the change is required including but not limited to the following:
• to add or remove participating retailers at which the Gift Card may be redeemed, or the goods and/or services which may be purchased using the Gift Card;
• to comply with all relevant laws, acts, ordinances, rules, regulations, other delegated legislation, codes and the requirements and directions of any relevant Commonwealth, State or Local Government Departments, bodies and public authorities, in force from time to time;
• for reasonable operational, administrative, compliance or corporate governance reasons, or to prevent the occurrence of fraud or other unlawful, unethical or unacceptable conduct; or
• where Stockland Shopping Centre, acting reasonably, considers that it will not cause detriment to the customer.
